The House Passed Disclosure in July. The Senate Has Not Touched the Bill Since.
The records-review board the House wrote into the defence bill is waiting on a Senate that has not held a vote on its own version since cloture failed in July — and the window before the midterms is weeks.
The Senate returned from its August recess on Monday with the fiscal 2027 defence authorisation exactly where it left it: not on the floor. 12 On July 14 a motion to proceed to the Senate bill failed a cloture vote 50 to 46, every Democrat and two independents voting no over the administration's military operations against Iran, and the majority leader switching his own vote to preserve a motion to reconsider. 234 No further procedural step has been taken since. 4
For this beat, that matters because the House version carries something the Senate version does not yet: the Burlison amendment, adopted on July 22, which would strengthen the UAP records collection at the National Archives and create an independent review process with subpoena and eminent-domain powers. 15 Senators Schumer and Rounds reintroduced their own UAP Disclosure Act in June for a fourth consecutive year. 7 It cannot be attached to a bill that is not being debated.
The conference problem
The reason advocates want the language in both bills is 2023. That year the Senate passed the full act, the House had nothing, and the strongest provisions — the review board, the eminent-domain authority — were cut in conference. 6 A provision that appears in only one chamber's bill is a bargaining chip. A provision in both is close to settled.
This year the positions are reversed. The House has acted, the Senate has not, and the clock is the problem. 1 The Senate will leave again ahead of the November midterms, and the defence bill historically clears about six weeks after the fiscal year starts on October 1. 2
Three years of hearings have produced a bill that one chamber passed and the other has not scheduled. That is not opposition. It is the calendar, and the calendar is worse.
What the campaign is for
The New Paradigm Institute launched a push on Monday urging the Senate to include the act in its bill, with its chief counsel arguing that the witnesses who testified under oath did not do so for their stories to die in a procedural void. 16
Whether the Senate takes up its bill at all before the election is a question about the Iran war and the budget topline, not about this subject. 23 The disclosure provisions will ride or fall on a fight they have nothing to do with. 7
